Terms of Service

1. Acceptance of Terms

By accessing or using Orchard ("the Service"), including our website, desktop application, and API, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Orchard is a marketplace for discovering, downloading, and managing resources for Minecraft servers. The Service allows users to publish, share, and download community-created content, and to buy and sell paid ("premium") resources.

3. User Accounts

You must create an account to publish content on Orchard. You are responsible for maintaining the security of your account and all activity that occurs under it. You must provide accurate information when creating your account.

You must be at least 13 years of age to use the Service. If you are under 18, you must have parental or guardian consent. To sell paid resources or receive payouts, you must be at least 18 years old (or the age of majority in your jurisdiction), as required by our payment processor.

4. User Content

You retain ownership of any content you upload to Orchard. By uploading content, you grant Pomme a non-exclusive, worldwide, royalty-free license to host, display, distribute, and make your content available to other users of the Service. For paid resources, this license also allows us to facilitate their sale, payment processing, and delivery to buyers.

You agree not to upload content that:

• Contains malware, viruses, or other harmful code
• Infringes on the intellectual property rights of others
• Is illegal, defamatory, or harassing
• Violates the privacy of others
• Misrepresents its functionality or purpose

5. Payments and Purchases

Some resources are offered for a price ("premium" resources). When you buy one:

• Payments are processed by our third-party payment provider, Stripe. By purchasing, you also agree to Stripe's terms and authorize the charge shown at checkout.
• Prices are displayed before purchase and charged in the currency shown. You are responsible for any taxes that apply to your purchase where required.
• A purchase grants you a license to download and use that resource under the license the creator has set. It does not transfer ownership of the underlying intellectual property or grant any right to redistribute or resell it.
• Orchard facilitates the transaction between you and the creator; the resource is provided by the creator, not by Pomme.

6. Selling and Payouts

You may offer resources for sale if you have the right to do so (see the Resource Rules). To sell paid resources and receive payouts:

• You must complete onboarding with our payment provider, Stripe, and be at least 18 (or the age of majority in your jurisdiction).
• Orchard charges a platform fee of 12% plus $0.30 per sale. The remainder is paid out to you via Stripe, subject to Stripe's payout schedule.
• You are solely responsible for reporting and paying any taxes on your earnings.
• Refunds and chargebacks on your sales, including any associated fees, may be deducted from your earnings or future payouts.
• You must have the legal right to sell each resource you list and must comply with its license and the Resource Rules.

7. Refunds

Because resources are digital goods delivered instantly, all sales are final once a resource has been downloaded. If a resource is broken, materially not as described, or was never delivered, contact us at contact@pomme.rs and we will review your case and may issue a refund at our discretion. This does not affect any rights you have under mandatory consumer law.

8. Prohibited Conduct

You may not:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or other user accounts
• Interfere with or disrupt the Service or its infrastructure
• Scrape or harvest data from the Service without permission
• Create multiple accounts to circumvent bans or restrictions
• Upload content that violates Mojang's or Microsoft's terms of use

9. Moderation

Pomme reserves the right to review, approve, reject, or remove any content at our sole discretion. All published content is subject to review by our moderation team. We may suspend or terminate accounts that violate these terms.

10. Availability and Modifications

We strive to keep the Service available at all times but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. We may update these terms, and continued use of the Service after changes constitutes acceptance.

11. Disclaimers

The Service is provided "as is" without warranties of any kind. Pomme is not responsible for any damage caused by content downloaded through the Service. Users download and install third-party content at their own risk.

Orchard acts as a marketplace and payment facilitator. Resources are created and provided by their authors, not by Pomme, and any agreement to buy or sell a resource is between the buyer and the creator.

12. Limitation of Liability

To the maximum extent permitted by law, Pomme shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
